1. Introduction

Welcome to RPG Haven! These Terms and Conditions (“Terms”) govern your access to and use of the RPG Haven mobile application (“App”) and associated services (collectively, the “Services”) provided by Dimitri Reisler, operating under his personal capacity (“we,” “us,” “our,” or “RPG Haven”). By accessing, downloading, installing, or using the App, you (“User” or “you”) agree to comply with and be bound by these Terms. If you do not agree with these Terms, you must not use the App.

About RPG Haven

RPG Haven is a mobile application designed to connect enthusiasts of tabletop role-playing games (TTRPGs), including but not limited to Dungeons & Dragons, Pathfinder, and Call of Cthulhu. The App offers a platform to find and join gaming groups by matching users based on shared interests, availability, and preferred gaming styles. Through features such as profile browsing, direct messaging, and advanced search filters, RPG Haven makes finding the ideal group for your next adventure easy and fun.

These Terms establish a legally binding agreement between you and RPG Haven regarding your use of the App and Services. They are supplemented by our Privacy Policy, which explains how we handle your personal data under GDPR and other applicable data protection laws.

The App is accessible globally, and you are responsible for ensuring compliance with all applicable laws in your jurisdiction.

2. Definitions

For the purposes of these Terms, the following definitions apply:

  • App: The RPG Haven mobile application, including all related software, services, and content.
  • User: Any individual who accesses, registers, or uses the App.
  • Content: Any text, images, graphics, videos, software, data, and other information, including User-generated content.
  • Services: All functionalities and features provided through the App, including account creation, profile browsing, messaging, and group-matching services.
  • User-Generated Content: Any content uploaded, posted, or otherwise provided by Users, including profile information, images, and messages.
  • Account: A registered User profile created to access the full features of the App.
  • Agreement: The legally binding contract formed by accepting these Terms.

3. User Eligibility

3.1 Minimum Age Requirement

The App is intended for use by individuals who are at least 16 years old. By registering or using the App, you confirm that you meet this age requirement. If you are under the age of 18, you affirm that you have the consent of a parent or legal guardian to use the App.

3.2 Compliance with Local Laws

You are responsible for ensuring that your use of the App complies with all applicable local, state, national, and international laws, regulations, and guidelines, including data protection, privacy, and age-specific laws. The App may not be used where prohibited by law.

3.3 Restricted Jurisdictions

RPG Haven may restrict access to the App in certain jurisdictions where providing the Services may violate local laws or expose RPG Haven to legal liabilities. We reserve the right to block access or terminate accounts where use is unlawful.

4. Account Registration and Management

4.1 Account Creation

To access certain features of the App, including creating a profile and messaging other Users, you must create an Account. During registration, you must provide accurate, current, and complete information. You agree not to create an Account using false information or on behalf of someone else without permission.

4.2 Account Security

You are responsible for maintaining the confidentiality of your Account login information, including your password. You agree to:

  • Not share your login credentials with anyone else.
  • Notify RPG Haven immediately if you suspect any unauthorized use of your Account or a security breach.
  • Accept responsibility for all activities that occur under your Account.

4.3 Account Termination or Suspension

We reserve the right to suspend or terminate your Account at our sole discretion, without notice, if you violate these Terms or if your behavior poses a risk to other Users or the integrity of the App. Suspended or terminated Accounts may lose access to all content and data associated with them, and RPG Haven is under no obligation to restore such data.

4.4 Account Deactivation by User

You may deactivate your Account at any time by following the instructions in the App settings. Upon deactivation, your profile may no longer be visible to other Users, but certain data may be retained in accordance with our Privacy Policy.

5. User Responsibilities and Conduct

5.1 General Conduct

You agree to use the App only for lawful purposes and in a manner consistent with these Terms and applicable laws. You must not:

  • Use the App in any manner that could damage, disable, overburden, or impair the Services or interfere with any other party’s use.
  • Use automated means to access the App or collect data without our express written permission.
  • Engage in harmful, fraudulent, deceptive activities, or violate the rights of others.

5.2 Prohibited Behavior

Specifically, you agree not to:

  • Post, upload, or share content that is illegal, offensive, defamatory, obscene, or otherwise inappropriate.
  • Engage in harassment, bullying, or abuse of any kind.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Solicit personal information from other Users for unlawful or commercial purposes.

5.3 Enforcement and Consequences

RPG Haven reserves the right to investigate and take appropriate legal action against anyone who violates these rules, including reporting to law enforcement, content removal, and Account suspension or termination.

6. User-Generated Content

6.1 License to Use Content

By uploading or posting any User-Generated Content, you grant RPG Haven a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works, and display such content in connection with providing the Services.

6.2 Ownership and Responsibility

You retain ownership of all User-Generated Content you submit. However, you are solely responsible for ensuring that your content does not infringe on third-party rights or violate laws.

6.3 Monitoring and Removal

We do not actively monitor all User-Generated Content but reserve the right to do so. We may modify, remove, or restrict access to any content that violates these Terms, infringes on third-party rights, or is otherwise inappropriate.

7. Content Moderation and Reporting

7.1 Reporting Mechanism

If you encounter content or behavior that violates these Terms, you may report it using the App’s reporting tools or by contacting us directly.

7.2 Investigation and Action

We will review reported content or behavior and take appropriate action, including content removal, Account suspension, or notifying law enforcement.

7.3 Disclaimer of Liability

RPG Haven is not liable for User actions or content. You acknowledge that all interactions with other Users are at your own risk, and we advise caution when interacting with others, both online and offline.

8. Intellectual Property Rights

8.1 Ownership of Intellectual Property

All intellectual property rights in and to the RPG Haven App, including but not limited to the software, design, text, graphics, logos, icons, images, audio clips, video clips, data compilations, and any other content provided by RPG Haven (“App Content”), are owned by Dimitri Reisler or licensed to RPG Haven. These materials are protected by German and international copyright, trademark, and other applicable laws.

8.2 Limited License to Users

Subject to compliance with these Terms, RPG Haven grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download, access, and use the App and Services for your personal, non-commercial use only. This license does not grant you any rights to:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any App Content.
  • Decompile, reverse engineer, disassemble, or otherwise attempt to discover the source code of the App.
  • Use the RPG Haven name, logo, or trademarks without prior written permission.

8.3 User-Generated Content Rights

While you retain ownership of your User-Generated Content, you grant RPG Haven a non-exclusive, royalty-free, worldwide, perpetual, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works, and display such content in connection with the Services and promotional activities.

9. Limited License to Use the App

9.1 Permitted Use

The App is provided solely for the purpose of connecting users for tabletop role-playing games and facilitating communications within this context. You may use the App and Services only for lawful purposes and in accordance with these Terms.

9.2 Prohibited Use

You agree not to use the App:

  • In any way that violates applicable local, national, or international laws or regulations.
  • For any unlawful, fraudulent, or malicious purposes.
  • To exploit, harm, or attempt to exploit or harm minors or vulnerable individuals.
  • To engage in data mining, data harvesting, or any other similar activity regarding the App or its users.
  • To introduce any malicious software, viruses, or other harmful technology into the App.

9.3 Reservation of Rights

All rights not expressly granted to you under these Terms are reserved by RPG Haven. Any unauthorized use of the App or Services may result in the suspension or termination of your Account and potential legal action.

10. Advertising and Monetization

10.1 Advertising Model

The RPG Haven App is free to use and is supported by advertisements. By using the App, you agree to the display of advertisements, including those provided by third-party ad networks. These ads may be based on general or anonymized data, in accordance with our Privacy Policy.

10.2 Third-Party Advertising and Links

The App may contain links to third-party websites, services, or advertisements that are not owned or controlled by RPG Haven. We do not endorse or assume responsibility for any third-party content or practices. Any interactions with third-party sites are solely at your own risk, and RPG Haven disclaims all liability for losses or damages arising from such interactions.

10.3 Ad Content Standards

We strive to ensure that all advertisements displayed on the App are appropriate and comply with applicable laws and standards. However, RPG Haven is not responsible for the accuracy, legality, or appropriateness of any third-party advertisements.

11. Limitation of Liability

11.1 No Liability for User Interactions

RPG Haven is not liable for any interactions or communications between Users, including any disputes, harassment, or harm that may arise from online or offline interactions. You acknowledge that you engage with other Users at your own risk.

11.2 General Limitation of Liability

To the fullest extent permitted by applicable law, RPG Haven, including its owner Dimitri Reisler, affiliates, and partners, shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, data, use, goodwill, or other intangible losses.
  • Damages related to your access to or use of, or inability to access or use, the App or Services.

11.3 Cap on Liability

In no event shall RPG Haven’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the App during the twelve (12) months prior to the claim.

11.4 Force Majeure

RPG Haven is not liable for any failure to perform due to events beyond its reasonable control, including natural disasters, technical failures, changes in law, or other unforeseen circumstances.

12. Disclaimer of Warranties

12.1 “As Is” and “As Available” Basis

The App and Services are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. RPG Haven does not warrant that:

  • The App will be secure, uninterrupted, error-free, or available at any particular time or location.
  • Any defects or errors will be corrected.
  • The App is free of viruses or other harmful components.
  • Any results from using the App will meet your requirements or expectations.

12.2 Disclaimers of Specific Warranties

To the fullest extent permitted by law, RPG Haven disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and title.

13. Indemnification

13.1 User Obligation to Indemnify

You agree to indemnify, defend, and hold harmless RPG Haven, Dimitri Reisler, and their affiliates, agents, and partners from any claims, liabilities, damages, losses, and expenses, including legal fees, arising from:

  • Your use of the App and Services.
  • Your violation of these Terms.
  • Your violation of any third-party rights, including intellectual property or privacy rights.
  • Any disputes or interactions with other Users, both online and offline.

13.2 Cooperation with Claims

You agree to cooperate fully with RPG Haven in defending against any claims. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you shall not settle any such matter without our prior written consent.

14. Data Protection and Privacy

14.1 Compliance with Privacy Policy

Your use of the App is also governed by our Privacy Policy, which details how we collect, use, store, and share your personal data.

15. Communication and Notifications

15.1 Consent to Electronic Communications

By using the App, you consent to receive electronic communications from RPG Haven, including but not limited to emails, push notifications, and in-app messages. These communications may include transactional information, promotional materials, updates to the App or Terms, and administrative messages.

15.2 Communication Preferences

You may manage your communication preferences through the App settings. You can opt-out of promotional communications at any time by following the unsubscribe instructions included in such messages. However, you may not opt-out of critical administrative or service-related communications.

15.3 Push Notifications

The App may send push notifications to your mobile device to provide updates and other relevant information. You can manage push notification preferences through your device settings.

15.4 No Liability for Communication Failures

RPG Haven is not liable for any communication failures, delays, or technical issues that may prevent you from receiving communications.

16. Third-Party Services and Links

16.1 Integration of Third-Party Services

The App may contain links to third-party websites, services, or resources that are not owned or controlled by RPG Haven. This may include third-party advertisements, offers, or other content provided by external parties.

16.2 Disclaimer of Liability for Third-Party Content

RPG Haven does not endorse or assume responsibility for any third-party websites or services. Accessing or using third-party content is at your own risk, and you should review the terms and privacy policies of any third-party services you engage with.

16.3 Third-Party Advertising

The App is supported by third-party advertisements. RPG Haven does not control the content of third-party ads and is not responsible for any issues arising from your interactions with advertisers. All transactions, communications, and disputes with advertisers are solely between you and the advertiser.

17. Termination and Suspension of Accounts

17.1 Termination by User

You may terminate your Account at any time by following the instructions in the App’s settings. Upon termination, your profile will no longer be visible to other users, but RPG Haven may retain certain data in accordance with our Privacy Policy.

17.2 Termination by RPG Haven

RPG Haven reserves the right to suspend or terminate your Account at its sole discretion, without prior notice, if:

  • You violate these Terms or engage in prohibited conduct.
  • Your behavior creates a risk of harm, legal liability, or disruption to the App or other users.
  • We are required to do so by law or regulatory request.

17.3 Effect of Termination

Upon termination of your Account:

  • You lose access to all features of the App, including your profile, messaging, and stored data.
  • Any User-Generated Content you have shared may remain accessible to other users if it has been re-shared or integrated into other features of the App.
  • RPG Haven is not obligated to retain, delete, or provide any data following termination, except as required by law.

17.4 Reinstatement of Accounts

Reinstatement of suspended or terminated accounts is at the sole discretion of RPG Haven. Requests for reinstatement must be submitted through our support channels and may require additional verification or agreement to specific conditions.

18. Changes to the App and Terms

18.1 Right to Modify

RPG Haven reserves the right to modify, update, or discontinue the App or Services, in whole or in part, at any time without prior notice. This includes adding, changing, or removing features and functionalities.

18.2 Amendment of Terms

We may revise these Terms from time to time. When significant changes are made, we will notify you by posting the updated Terms within the App or through other communication channels. The “Last Updated” date at the top of this document will reflect the latest revision date.

18.3 Acceptance of Updated Terms

By continuing to use the App after updated Terms are posted, you agree to be bound by the new Terms. If you do not agree with the changes, you must discontinue use of the App.

18.4 Temporary Suspension or Maintenance

We may temporarily suspend access to the App for maintenance, updates, or emergency repairs. During such times, we will strive to minimize disruption but are not liable for any inconvenience or data loss.

19. Dispute Resolution

19.1 Preferred Method: Negotiation

In the event of a dispute arising out of or related to these Terms or your use of the App, you agree to first attempt to resolve the dispute informally by contacting RPG Haven at the provided support channels.

19.2 Mediation and Arbitration

If an informal resolution is not possible, disputes may be submitted to mediation or binding arbitration under the rules of a recognized arbitration body in Germany, unless prohibited by applicable law.

19.3 Exclusion of Class Actions

All claims must be brought on an individual basis, and you agree not to participate in any class action, consolidated, or representative legal proceeding against RPG Haven.

19.4 Exceptions

Notwithstanding the foregoing, RPG Haven reserves the right to seek injunctive or other equitable relief in any jurisdiction to prevent the infringement of intellectual property rights or unauthorized access to the App.

20. Governing Law and Jurisdiction

20.1 Governing Law

These Terms are governed by and construed under the laws of Germany, without regard to its conflict of law principles.

20.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in Berlin, Germany for the resolution of any disputes arising from or related to these Terms or your use of the App.

20.3 International Use

Although the App may be accessible worldwide, RPG Haven makes no representation that the Services are appropriate or available for use in all locations. Users accessing the App from outside Germany are responsible for compliance with local laws.

21. Liability for Offline Interactions

21.1 No Responsibility for Offline Meetings

RPG Haven only facilitates connections between users for tabletop role-playing games and is not involved in actual offline interactions between users. You acknowledge that any meetings or interactions outside the App are at your own risk.

21.2 Recommendations for Safe Interactions

We strongly recommend taking precautions when meeting other users in person, including:

  • Meeting in public places.
  • Informing a friend or family member of your plans.
  • Trusting your instincts and taking safety measures.

21.3 Disclaimer of Liability

To the fullest extent permitted by law, RPG Haven disclaims all liability for any harm, injury, loss, or damage arising from or related to offline interactions between users.

22. Children’s Online Privacy Protection

22.1 Not Intended for Children Under 16

The App is not intended for use by children under the age of 16. By using the App, you confirm that you are at least 16 years old, or if under 18 years old, that you have obtained parental or legal guardian consent.

22.2 Compliance with COPPA

Although RPG Haven operates under German law, we strive to comply with international standards such as the Children’s Online Privacy Protection Act (COPPA) in the United States. We do not knowingly collect personal information from children under 16.

22.3 Actions Upon Discovery of Underage Users

If we become aware that a user under 16 has provided personal information, we will take steps to delete such information and terminate the Account. If you believe we might have collected data from a child under 16, please contact us immediately at support@rpghaven-app.com.

23. Force Majeure

23.1 Definition of Force Majeure Events

RPG Haven shall not be liable for any failure to perform or delay in performance of any obligations under these Terms due to circumstances beyond our reasonable control (“Force Majeure Event”). These events include but are not limited to:

  • Natural disasters such as earthquakes, floods, fires, or extreme weather.
  • Government actions, laws, or regulations.
  • War, hostilities, or civil unrest.
  • Technical disruptions, such as failures of the internet, telecommunications networks, or infrastructure.
  • Cyberattacks, including DDoS attacks, malware, and hacking incidents.
  • Strikes, labor disputes, or shortages of labor or materials.

23.2 Consequences of Force Majeure Events

In the event of a Force Majeure Event, our obligations under these Terms will be suspended for the duration of the event. We will make reasonable efforts to mitigate the impact and resume the Services as soon as feasible.

24. Severability

24.1 Interpretation of Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible under applicable law. The remaining provisions of these Terms shall continue in full force and effect.

24.2 Modification of Invalid Provisions

If necessary, the invalid provision shall be replaced with a valid provision that most closely reflects the original intent of the parties and maintains the economic and legal effect of the original provision.

25. Entire Agreement

25.1 Comprehensive Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and RPG Haven concerning your use of the App and Services. These Terms supersede all prior or contemporaneous communications, proposals, understandings, or agreements, whether oral or written.

25.2 No Waiver

Failure by RPG Haven to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of rights under these Terms must be in writing and signed by an authorized representative of RPG Haven.

25.3 Assignment

RPG Haven may assign its rights and obligations under these Terms to any third party without your prior consent. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

25.4 Headings for Convenience Only

The headings used in these Terms are included for convenience only and will not limit or affect the interpretation of the Terms.
